Last updated: January 30, 2026
These Terms of Service ("Terms") govern your access to and use of Distress Meter AI (the "Service") operated by Seattle Digital, LLC ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service provides AI-assisted property condition insights based primarily on publicly available imagery and related data sources. Outputs may include a distress score and short descriptive tags.
2. Not Professional Advice
The Service is provided for informational purposes only and does not provide professional advice. The Service is not legal advice, financial advice, investment advice, appraisal services, or a substitute for an on-site inspection.
No reliance for investment decisions. You agree that you will not rely on the Service as the sole basis for any investment, purchasing, financing, underwriting, or other business decision. You are responsible for performing your own due diligence.
3. AI Outputs, Estimates, and No Guarantees
The Service uses automated processes and machine learning models. Outputs are estimates and opinions and may be incomplete, inaccurate, or outdated. We do not warrant that the outputs will be correct, complete, or suitable for any particular purpose.
4. Permitted Use and Allocation of Risk
The Service is intended for business use by companies and individual wholesalers operating in a commercial capacity.
You may use the Service and its outputs in your workflows (including for internal evaluation, marketing, appraisals, legal proceedings, disputes, or automated decision-making affecting individuals) at your own risk. You acknowledge that we make no warranties as to fitness for such purposes and assume no liability for decisions or outcomes based on the outputs.
5. Accounts and Security
- You must provide accurate information and keep it up to date.
- You are responsible for maintaining the confidentiality of your account and credentials.
- You are responsible for all activity that occurs under your account.
6. Free Trial
We may offer a free trial that includes 20 total addresses per account across Bulk and API usage. No credit card is required for the free trial. Free trial limits are non-renewable and may be modified or discontinued at any time.
7. Billing, Usage Units, and Limits
Prices are listed in USD. Subscriptions (if offered) are billed monthly.
- Billing unit: 1 successfully processed address = 1 billing unit.
- Addresses that fail processing are not charged.
- Unused units do not roll over.
- Add-ons (if available) apply only to the current billing period and expire at period end.
8. Refunds
All fees are non-refundable except where a billing error is confirmed by the Company. Add-ons are non-refundable.
9. Subscription Cancellation
You may cancel your subscription at any time. Cancellation is effective at the end of the current billing period. You will retain access through the end of that period. No refunds are provided for partial periods.
10. Acceptable Use
You agree not to:
- scrape, crawl, or automate access to the Service in a way that circumvents limits or protections
- benchmark, compare, or publish performance evaluations of the Service without our written consent
- reverse engineer or attempt to extract underlying models, prompts, or system logic
- use the Service for unlawful activities or to violate the rights of others
11. Sharing and Resale of Outputs
You may share or resell the outputs (e.g., CSV results, API responses) to your team or clients. You may not resell access to the Service itself, offer white-label access, or provide your own users with direct API access under your account unless we have a separate written agreement.
12. Third-Party Services
The Service may use third-party providers (for example, authentication, cloud infrastructure, or imagery sources). Third-party services may be subject to their own terms and policies.
13. Availability; No SLA
The Service is provided on a best-effort basis. We do not guarantee uptime, availability, response times, or that the Service will be uninterrupted or error-free.
14. Intellectual Property
The Service, including software, models, branding, and all related intellectual property, is owned by the Company or its licensors. You retain any rights you have in address lists you submit.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of Liability
To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities.
In all cases, the Company’s total liability arising out of or related to the Service will not exceed the amounts paid by you to the Company for the Service in the 30 days immediately preceding the event giving rise to the claim.
17. Indemnification
You agree to indemnify and hold harmless the Company from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your outputs, your violation of these Terms, or your infringement of any rights of another.
18. Termination
We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, abused the Service, or if required to comply with law.
19. Arbitration Agreement and Class Action Waiver
Please read this section carefully. It affects your rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules. Arbitration will take place in King County, Washington, unless the parties agree otherwise.
Class Action Waiver: You and the Company agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
20. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, except that the arbitration agreement is governed by the Federal Arbitration Act.
21. Changes to These Terms
